1. Acceptance

By accessing and using the website web-space.com.mx and its tools (the “Service”), you agree to comply with and be bound by these terms and conditions. If you do not agree with any part of these terms, do not use our services.

These terms apply to users in Mexico, the United States, the European Union, and any other jurisdiction. By using the service, you confirm you have legal capacity to contract under your local laws.

2. Nature of the Service

Web Space MX provides cybersecurity consulting, performance engineering, and web development services. The automated tools available on the site (such as AI Scanner, DNS Check) are diagnostic and preliminary. They do not replace a full professional audit performed by a human expert.

4. Ethical Use

You represent and warrant that you are the owner or have express authorization to scan, analyze, or audit the domains, code, or infrastructure you enter into our tools.

Strictly prohibited:

• Using our tools to scan third-party targets without consent (unethical hacking).
• Attempting to reverse engineer our platform.
• Using reports to extort or damage third-party reputations.

Web Space MX will cooperate with authorities if malicious use is detected.

5. Intellectual Property

All content, design, logos, source code, and methodology on this site are the exclusive property of Web Space MX and protected by Mexican and international intellectual property laws.

6. Limitation of Liability

In no event shall Web Space MX be liable for direct, indirect, incidental, special, consequential, or punitive damages arising from the use or inability to use our services, including but not limited to:

• Loss of profits, data, reputation, or business opportunities.
• Service interruptions or errors in automated reports.
• Cyberattacks resulting from vulnerabilities not detected by our tools.

Maximum liability cap: Web Space MX’s aggregate liability will not exceed the amount paid by the user in the last 12 months for the specific service that gave rise to the claim, or USD $100 (whichever is greater).

This limitation applies to the fullest extent permitted by law. Some jurisdictions do not allow exclusions of implied warranties or limitations of liability for consequential damages; in such cases, the above limitations may not apply.

7. Dispute Resolution

Mediation and Arbitration: Before initiating any judicial proceeding, the parties agree to attempt to resolve disputes through:

• 1. Direct negotiation: Contact [email protected] within 30 days of the dispute arising.
• 2. Mediation: If negotiation fails, the parties agree to mediation through the applicable Chamber of Commerce (Mexico: CANACO, USA: AAA, EU: per jurisdiction).
• 3. Binding arbitration: If mediation fails, the dispute shall be resolved by arbitration under UNCITRAL rules, seated in Mexico City, Spanish language, with a single arbitrator mutually appointed.

8. Jurisdiction & Law

These terms are governed by the laws of Mexico, without prejudice to conflict-of-law rules. For users residing in:

• 🇪🇺 European Union: GDPR and consumer protection laws of your country apply.
• 🇺🇸 United States: Applicable federal and state laws (including CCPA for California).
• 🇲🇽 Mexico: LFPDPPP, Commercial Code, and Federal Consumer Protection Law.

As a last judicial resort (after arbitration), the parties submit to the exclusive jurisdiction of the competent courts in Mexico City, waiving any other venue.

9. Warranties

THE SERVICE IS PROVIDED “AS IS” AND “AS AVAILABLE.” Web Space MX disclaims all express or implied warranties, including but not limited to:

• Warranties of merchantability, fitness for a particular purpose, and non-infringement.
• Warranties that the service will be uninterrupted, secure, or error-free.
• Warranties regarding accuracy, reliability, or completeness of results.

10. Indemnification

You agree to indemnify and hold harmless Web Space MX, its directors, employees, and agents from any claim, damage, loss, liability, and expense (including reasonable attorney’s fees) arising from:

• Your violation of these Terms of Service.
• Unauthorized use of our tools to scan third-party targets.
• Violation of intellectual property or privacy rights of third parties.

11. Termination

Web Space MX reserves the right to suspend or terminate your access immediately, without prior notice, for:

• Violation of these terms or acceptable use policies.
• Fraudulent activity or abusive behavior.
• Requests from competent authorities.
• Service discontinuation (with 30 days’ prior notice).

You may cancel your account at any time by contacting support. Payments are non-refundable unless required by law.
